Dear F-1 visa students,

This email is to provide an update on the case back in August of the U.S. District Court vacating the STEM OPT extension rule. You may recall that the court found the rule allowing for F-1 student STEM extension of OPT to be invalid, because the government did not follow proper procedures to have the rule approved back in 2008. The government was given until February 12, 2016 to resubmit the OPT rule following proper procedures for approval.

Update: On October 2nd, the Department of Homeland Security submitted a new proposed STEM Rule to the Office of Budget and Management (OMB) for review. After OMB approves this proposal, the rule can be published in the Federal Register and will be opened up for public comment. At that point, we will know the details of the new proposed rule. After the public comment period, DHS will need to publish the rule in the Federal Register (making it final).

This is very good news for international students with F-1 visas, as it shows that the government is taking steps to ensure that the STEM OPT rule is not vacated for good, and they are following the proper procedures to have the law approved this time. We will keep you updated as more details are known!
